PUTRAJAYA, 7 October 2025: The Vehicle Theft and Accident Reduction Council of Malaysia (VTAREC) held a seminar on “Tadbir Urus dan Pembaikan Kenderaan BER”. This seminar was held with government enforcement agencies including Polis Diraja Malaysia (PDRM) and Jabatan Pengangkutan Jalan Malaysia (JPJ).

The strategic seminar was held at The Everly Putrajaya Hotel, Putrajaya. The seminar was attended with great anticipation. The objectives of the strategic seminar were to knowledge exchange with respect to recent developments concerning the topic on Beyond Economic Repair (BER) and Actual Total Loss (ATL) including smuggling, cloning and stolen spare parts associated with road traffic accidents.
The experts from diverse agencies were invited to deliver their sharing and presentation at the seminar. The speakers who graciously attended were:

YBrs Encik Benildus Saw, Managing Director of Justicia Adjusters Sdn Bhd delivered his presentation as the first speaker on “Apakah yang dimaksudkan dengan Beyond Economic Repair (BER) dan antara cara mengenal pasti sebuah kenderaan BER serta perbezaannya dengan Total Loss (ATL)?”
This session focused on the explanation of Beyond Economic Repair (BER) and Actual Total Loss (ATL), including their definitions, key differences and financial factors involved in classifying damaged vehicles. The presentation highlighted how repair costs, spare parts, labour, structural damage and hidden damages influence a vehicle’s BER or ATL status. It also emphasised the importance of proper assessment based on market value, safety standards and industry guidelines to avoid premature judgments and ensure accurate insurance decisions.

This session discussed the establishment and development of VTAREC, its role in addressing vehicle theft, and its expanded responsibility in tackling road accidents in Malaysia. The presentation also highlighted current accident statistics, high-risk vehicle categories, and the importance of collaboration between government agencies, the insurance industry and key stakeholders. Overall, the sharing emphasised VTAREC’s continuous efforts and strategic initiatives in strengthening road safety and reducing vehicle-related crimes nationwide.

This session explained the role and responsibilities of workshops in handling vehicles classified as Beyond Economic Repair (BER) in accordance with the guidelines set by Jabatan Pengangkutan Jalan Malaysia (JPJ). The presentation covered the definition and criteria of BER vehicles, controlled structural panels, required documentation, and the proper repair process including approval and inspection by PUSPAKOM. It also emphasised strict compliance with legal requirements, the use of approved spare parts, accurate documentation, and the prohibition of unauthorised modifications or fraudulent practices to ensure that repaired vehicles are safe and roadworthy for public use.
YBhg Dato’ Ooi Win Juat, Advisor of Pusat Pemeriksaan Kenderaan Berkomputer (PUSPAKOM) Sdn Bhd as the fourth speaker delivering his sharing on “Apakah peranan PUSPAKOM di dalam membaiki kenderaan diisytihar BER mengikut garis panduan JPJ?”
This session outlined the role of PUSPAKOM as an independent inspection body in ensuring that vehicles classified as Beyond Economic Repair (BER) comply with JPJ safety and technical guidelines before being allowed back on the road. After the repair work is completed with prior approval from JPJ, the vehicle is required to undergo a mandatory physical inspection at PUSPAKOM to verify its structural integrity, braking system, steering system and overall roadworthiness. The session emphasised that this inspection process is a critical control measure to ensure that only safe and compliant vehicles are returned for public use.
The participants of the seminar expressed positive comments and took an active role in expressing their view points and asking questions to deepen their grasp of the issues that were addressed. The subject of Beyond Economic Repair (BER) and its relation to accidents have been the focus of each presentation that has been given by the speakers.

The Q&A session started with the representative from Motordata Research Consortium Sdn Bhd (MRC) asked a question, “Can Justicia Adjuster’s debt assessment process be more clearly standardized to avoid being overly subjective?”
The answer from Mr. Benildus Saw of Justicia Adjuster highlighted that there is indeed room for standardisation to achieve a professional conclusion. Improvements are needed not only within the industry but also at the national level. The main focus, he emphasised, is on enhancing knowledge, skills and integrity.
Puan Suhaily from the Malaysian Takaful Association shared her thoughts and information with all seminar participants, highlighting that we can check at www.jomcheck to ensure that any second-hand car we intend to buy has not been involved in any accidents. She explained that the data comes from all insurance companies and the relevant individuals who have made claims for accidents.
Tuan Norazman Nordin from Jabatan Pengangkutan Jalan Malaysia (JPJ) also emphasised that data from PUSPAKOM on cars that have been involved in accidents and certified by PUSPAKOM should be included in the database. This would help ensure that the status of the vehicle whether BER or TL can be accurately determined.
Puan Suhaily from the Malaysian Takaful Association also asked a question, “How do consumers check if a resold car has passed PUSPAKOM inspection?”
In response to Puan Suhaily’s question, Datuk Lokman, Chairman of VTAREC, explained that any car intended for ownership transfer must undergo inspection at PUSPAKOM. PUSPAKOM will verify whether the vehicle is still roadworthy and fit for use. Dato’ Ooi Win Juat, Advisor of PUSPAKOM, added that PUSPAKOM checks three main things during inspection: whether the car has been reassembled, the condition of tinted windows, and the car frame.
